TERMS OF USE
PROJECT SCOPE TERMS: Any modifications to any Site Wizard/Word Press module will require a Project Specification and Genuine Quality Enterprises, LLC will provide the Client with a cost and time estimate for making these modifications.
PRODUCTION TIMELINE: The Client understands that he/she is responsible for providing Genuine Quality Enterprises, LLC with all the materials, content, and other information necessary for Genuine Quality Enterprises, LLC to be able to complete the Project. The Client also understands that failure to provide these materials to Genuine Quality Enterprises, LLC may cause the Project to fall behind schedule and that the Client cannot hold Genuine Quality Enterprises, LLC liable for such a schedule change. The Client understands that Genuine Quality Enterprises, LLC will collect the final balance due from the Client at the time that the Graphics have been approved, as signified by the Client's signature on the Graphics Approval Form. It is also understood that, should the Project be idle for 60 days after initial order date due to the Client’s failure to provide Genuine Quality Enterprises, LLC with any required materials, graphics, photos, website copy, or approval signatures, Genuine Quality Enterprises, LLC reserves the right to collect final fees due from the Client, regardless if the project has been completed. The Client understands that all project-related contact between the Client and Genuine Quality Enterprises, LLC must be channeled through the Project Manager or Account Executive, and there is to be no direct contact with a Genuine Quality Enterprises, LLC Programmers or Graphic Artists without express consent of the Project Manager.
WARRANTY: Genuine Quality Enterprises, LLC provides no warranties, express or implied, for any of its products or services, except specified within this document:
Code Bugs: Genuine Quality Enterprises, LLC shall conduct thorough testing of the code and HTML markup written for this Website Project before final release to the Client. The Client understands that, from time to time bugs or other functional issues may arise after initial testing by Genuine Quality Enterprises, LLC, These functional issues may be due to a number of factors, including server differences, browser inconsistencies, the interaction of different complex systems within the Website, and the influence of heavy use by a larger number of users. It is for these reasons that Genuine Quality Enterprises, LLC advises the Client to undergo a beta testing stage, where the Website functionality is thoroughly tested by a broader spectrum of individuals at the same time. No Websites will be launched on Friday’s. Any outstanding balances must be paid to Genuine Quality Enterprises, LLC in order for Client Websites to be made live on the Internet. There is a 90 day code warranty in place. After the website is live for 90 days, any bugs discovered after that period become billable time to client based on estimate provided by Genuine Quality Enterprises.
Client-Introduced Bugs: As most of the Website administration interfaces built by Genuine Quality Enterprises, LLC, Inc., accommodate the entry of HTML code by the Website owner, the Client understands that any bugs or display problems that are caused by code entered into the Website administration interface by the Client are not the fault of Genuine Quality Enterprises, LLC and are therefore billable fixes in the event that Genuine Quality Enterprises, LLC’s intervention is needed to resolve the problem.
The Client understands that the billable time in this situation includes all time spent by Genuine Quality Enterprises, LLC in resolving the issue, including: time spent on the phone with the Client discussing the problem, time and materials spent troubleshooting and diagnosing the problem, and time and materials spent in resolving the problem. The Client understands that this kind of support work is billed at current per hour rates.
Browser Compatibility: This Website or Website component will be optimized to function correctly with the following browsers and versions: Windows XP; Vista; Safari; Firefox; IE7 and IE8. Genuine Quality Enterprises, LLC will test your site on current browser versions. If you have an earlier version, you will need to upgrade to the latest version. Genuine Quality Enterprises, LLC will not adjust its programming and graphics to accommodate lesser versions on the above-mentioned changes to the design, unless it is billable time to Client. We cannot accommodate every screen size, browser version and type of operating system in use. We will do our very best to have the site function effectively on as many platforms as possible. Client also understands that browser technologies are constantly changing, and therefore, Genuine Quality Enterprises, LLC may revise its browser compatibility warranty as needed to keep up with emerging technologies.
User Definable Features: The Client understands that certain browser behaviors and functions can be enabled and disabled by the end user. This includes: font styles and sizes, acceptance of cookies, and JavaScript. For this reason, Genuine Quality Enterprises, LLC cannot guarantee exactly how a Website or Website component may appear or function for every end user.
Code Ownership/Hosting terms for Site Wizard & Word Press: The Client understands that, unless otherwise specified within this document, Genuine Quality Enterprises, LLC maintains ownership of the code written in the course of development of this project using Site Wizard. This includes any language such as PHP, Perl, and HTML. This also includes the database architecture, if applicable. The Client understands that what the Client owns upon Project completion is the textual and pictorial content of the Website. Site Wizard websites MUST be Hosted on Genuine Quality Enterprises’s servers. Websites developed using Word Press technology can be hosted on other servers and code ownership is property of the client.
TECHNICAL SUPPORT: All reasonable efforts will be made to assist the Client in the use and maintenance of the products and services ordered. In the event that the new Website or Website component being built contains a new Web-based administration section (i.e., a Website “control panel” where the Website owner may edit his/her own content) for which the Client has not yet received instruction, Genuine Quality Enterprises, LLC offers regularly scheduled Website administration training classes. The Client should sign up to sit in on one of these training classes, which are offered free of charge. Those Clients that cannot attend training due to distance will be formally trained via phone. The Client understands if any additional training or assistance is needed in a private session, the Client will be billed at current per hour rates. In addition, the Client should also understand that other complex technical issues or needs for priority support assistance will be billed at current per hour rates. This includes, but is not limited to: networking assistance, proxy configurations, network hardware configuration, software issues, and Internet-related software tutoring. Genuine Quality Enterprises, LLC does not provide any on-site Networking services unless otherwise retained for those specific services. Genuine Quality Enterprises, LLC is not responsible for Client’s network.
Emergency Technical Support: Genuine Quality Enterprises, LLC’s technical support department is available Monday through Friday, between 9:00 A.M. and 5:00 P.M. EST, excluding company holidays. In the event that the Client has a Technical Support need at a time other than this, help can be reached through Genuine Quality Enterprises, LLC’s emergency technical support line. Only Websites with a “Site Down” emergency qualify for emergency technical support. A “Site Down” emergency is described as a situation where the Client’s Website fails to come up at all when the users attempt via the Client’s Domain (or IP address). Examples of situations that are not considered a “Site Down” emergency are: a component of the Website is not functioning properly, but the site itself comes up when accessed via the Web; domain-related Emails not functioning properly. Non -“Site Down” technical support issues can be addressed starting at 9:00 A.M. the following business day.
Web Hosting & Email Terms: The Website will be hosted at Genuine Quality Enterprises, LLC’s current monthly rate unless otherwise specified. The monthly rate includes: 1000MB of web file storage. It also includes 10 Domain-related Email POP (Post Office Protocol) accounts. Under no circumstances shall Client send unsolicited bulk Email from or relating to the Website via Genuine Quality Enterprises’ email servers. If you are setup for monthly credit card billing for your Hosting, Genuine Quality Enterprises, LLC will debit your first and last month payment in advance.
CLIENT NETWORK: Genuine Quality Enterprises is not responsible for email or website issues caused by internal firewalls, internet connectivity or client’s internal network. If our trouble shooting techniques indicate there is an issue on the clients end, client is responsible for contacting their IT company to resolve the issue. Genuine Quality Enterprises, LLC does not provide any on-site Networking services.
SITEWIZARD MAILING LIST DISTRIBUTION SYSTEM: The Mailing List Distribution System allows for you to capture Email addresses from users voluntarily submitting to your site and this also allows for you to upload a pre existing Email lists into the system for bulk Emailing and/or sending out company newsletter through the mailing list database. This allows for 1000 outbound Emails through the system per month if utilized. Any outbound Emails over 1000, in increments of 1000, add’s $2 to the Hosting rate if you are using the Mailing List Distribution System.
GOVERNING LAW: This Agreement will be governed, construed and enforced in accordance with the laws of the State of South Carolina without giving effect to principles of conflict laws. Both parties agree to submit to exclusive jurisdiction of South Carolina with respect to this Agreement and further agree that any cause of action relating to this Agreement shall be brought and maintained in a court in Richland County, South Carolina.
Refund Policy: All deposits are non-refundable and client shall fulfill all obligations in accordance with this agreement. Client shall fulfill the total amount of this agreement, even in the event client voluntarily terminates agreement.
All sales are final.
